Estimated reading time: 3–4 minutes

Washington, D.C. – On October 8, 2026, the U.S. International Trade Commission (USITC) received a complaint from Cytek Biosciences, Inc. The complaint is about certain spectral flow cytometry systems and their parts.

The complaint alleges violations of section 337 of the Tariff Act of 1930. The alleged violations are related to the importation and sale of these systems in the United States.

The respondents named in the complaint are Beckman Coulter, Inc., based in Brea, California, and Beckman Coulter Biotechnology (Suzhou) Co., Ltd., based in China.

Cytek Biosciences requests the USITC to issue a limited exclusion order and cease and desist orders. These orders would stop the importation and sale of the infringing products.

The USITC is asking for comments from the public. They want to know about any public interest issues caused by this complaint.

Public comments are welcome on several topics. One, how these products are used in the United States. Two, concerns about public health, safety, or welfare. Three, if there are similar products made in the U.S. that could replace the imported ones. Four, whether Cytek or others can make enough products to replace the imported ones. Five, how U.S. consumers might be affected.

The public can submit comments until eight days after this notice is published. Comments should follow the guidelines and be submitted electronically.

Written submissions must refer to Docket No. 3943. They should not be longer than five pages. People can file replies to other submissions by the third day after initial submissions are due.

For help with electronic filing, people can contact the Secretary to the Commission through the contact details provided.

Confidential treatment of documents can be requested if the information is sensitive. All non-confidential documents will be public.

This process is in line with section 337 of the Tariff Act of 1930 and the Commission’s rules.
