U.S. International Trade Commission Updates Investigation on Electric Aircraft
Estimated reading time: 1–7 minutes
The U.S. International Trade Commission (ITC) has announced an update regarding a patent investigation involving Archer Aviation Inc. The Commission decided not to review an administrative law judge’s decision to change the notice of the investigation’s start to fix a mistake.
Archer Aviation Inc. is located in San Jose, California. The company is involved in an investigation that started on April 14, 2026. This investigation focuses on certain electric aircraft and their parts. The investigation looks into whether these items are imported, sold to be imported, or sold in the U.S. after being imported. The investigation wants to see if these actions break certain U.S. patent laws.
The patents in question include U.S. Patent No. 11,945,594, U.S. Patent No. 12,162,614, U.S. Patent No. 8,469,306, U.S. Patent No. 12,103,404, and U.S. Patent No. 12,473,087. There was a mistake in the initial notice about one of the patents. The patent number was reported as U.S. Patent No. 12,472,087. However, the correct number is U.S. Patent No. 12,473,087.
The respondents, Joby Aero, Inc. and Joby Aviation, Inc. from Santa Cruz, California, are part of this investigation. The Office of Unfair Import Investigations is also a participant.
On September 4, 2026, Archer Aviation Inc. asked to change the notice to correct the mistake. The judge agreed to this on September 8, 2026. No one asked for a review of this decision.
The Commission’s decision took place on October 6, 2026. The ITC’s decision is based on the Tariff Act of 1930 and the Commission’s own rules.
This correction ensures the investigation into the alleged patent infringement continues accurately.
